Terms and Conditions of Using the Robotics Repository
(“Terms and Conditions”)
I. General provisions
- These Terms and Conditions define the rules of using the electronic repository – the Robotics Repository – digital sharing of scientific resources in the field of robotics (the “Robotics Repository”).
- The Robotics Repository is operated by Łukasiewicz Research Network – Industrial Institute of Automation and Measurements PIAP at the following address: Al. Jerozolimskie 202, 02-486 Warszawa (“Łukasiewicz – PIAP”) through a website available at roborepo.pl:8443.
- The purpose of the Robotics Repository is to make the following works available on the internet, among others:
1) resources of Łukasiewicz – PIAP library, primarily on robotics, mechatronics, Artificial Intelligence;
2) scientific journals issued by Łukasiewicz – PIAP;
3) studies primarily on robotics carried out by Łukasiewicz – PIAP and completed;
4) publications;
5) scientific articles;
6) articles and other resources stored on external servers;
7) volumes in the possession of Łukasiewicz – PIAP;
8) contemporary digital materials (among others, PDF files, software, audio and video files, 3D scans, sets of text data for benchmarking);
except for resources covered by the confidential/secret clause,
hereinafter referred to as the “Materials”.
- The Robotics Repository enables:
1) storing and making the Materials publicly available;
2) viewing and downloading the Materials.
- Using the Robotics Repository is free of charge.
- Using the Robotics Repository means consent to complying with these Terms and Conditions.
II. Rules of using the Robotics Repository
- It is not necessary to comply with any specific technical requirements to use the Robotics Repository, however, this may be required to use certain functions of the Robotics Repository. Information on such specific requirements is available on an ongoing basis on the Robotics Repository.
- In order to use the Robotics Repository, it is necessary to have access to a computer or another device with internet connection.
III. Rules of uploading and making the Materials available
- The Materials are uploaded to the Robotics Repository in accordance with the rules specified in these Terms and Conditions.
- Authors or holders of rights to the Materials provide Łukasiewicz – PIAP with an appropriate license.
- Authors or holders of rights to the Materials provide all users of the Repository and Łukasiewicz – PIAP with licenses to the Materials under the Creative Commons BY 3.0 PL free license, full provisions of which are available at http://creativecommons.org/licenses/by/3.0/pl/legalcode (hereinafter referred to as the “CC-BY”), by submitting a written declaration.
- In the case of Materials to which Łukasiewicz – PIAP holds property rights, decision on their uploading to the Repository and the selection of the Creative Commons Free License is made by a person authorised by the Director of Łukasiewicz – PIAP. Research data are uploaded in agreement with their author.
- It is prohibited to provide illegal content, in particular to store and make the following Materials available in the Robotics Repository:
1) Materials which the user is not authorised to distribute (e.g. where proprietary copyrights have been transferred to a third persons);
2) Materials the distribution of which violates the rights of third persons in another way, including their personal interests;
3) Materials the distribution of which is contrary to other provisions of law.
- It is prohibited to provide content that is contrary to principles of morality, including content that undermines principles of scientific reliability.
- Before making them available in the Robotics Repository, Materials uploaded by their author or creator in the manner described above must each time be approved by the person appointed by Łukasiewicz – PIAP.
- The Materials are available in the Robotics Repository to all interested persons free of charge, based on the Creative Commons Free Licenses without any time or territorial restrictions.
- The User may store and make the Materials publicly available in the Robotics Repository, as well as use additional functions of the Repository available in accordance with its current technical conditions.
- Łukasiewicz – PIAP will inform the users of the Robotics Repository about the declaration on granting the CC-BY by means of an appropriate marking on the site dedicated to each Material. If such a declaration is not made, Łukasiewicz – PIAP will inform the users of the Robotics Repository that using such Materials is possible in accordance with appropriate provisions on permitted use or other exceptions provided for by law, and more extensive use requires obtaining the consent of the rights holder.
IV. Complaints, questions and comments
- Any complaints should be submitted by a registered letter sent to the following address: Sieć Badawcza Łukasiewicz – Przemysłowy Instytut Automatyki i Pomiarów PIAP, address: Al. Jerozolimskie 202, 02-486 Warszawa.
- The complaint should contain a designation of the person submitting it for identification purposes and a short description of the problem.
- The complaint will be handled immediately, of which the person submitting it will be notified to the address given in the complaint.
V. Duties of the user of the Robotics Repository
The user of the Robotics Repository commits:
1) to comply with these Terms and Conditions, use the services and tools
available in the Robotics Repository that have been provided to him/her in accordance with their intended purpose,
use methods and equipment that do not disturb the operation of the IT infrastructure,
2) not to take any action contrary to the intended purpose of the Robotics Repository,
3) to ensure that the use of the Robotics Repository will be compliant with generally applicable provisions of law, in particular copyright, and principles of morality
VI. Liability
- The author of or holder of rights to the Materials is fully liable for the uploaded Materials and bears responsibility for any violations of third-party rights and placing content that may violate generally applicable provisions of law.
- Łukasiewicz – PIAP will make every effort so that the use of the Robotics Repository is possible without any major interruptions or other disturbances, and using the highest number of configurations of equipment and software available on the market.
- In the event of receiving an official notification or obtaining reliable information about the illegal character of the Materials or activities related thereto, Łukasiewicz – PIAP will immediately block access to such Materials.
- Łukasiewicz – PIAP may refuse to store or make publications publicly available, block access to or remove from the Robotics Repository any data not constituting the Materials within the meaning of these Terms and Conditions, as well as data not compliant with the provisions of these Terms and Conditions.
VII. Amendments to the Terms and Conditions
- Łukasiewicz – PIAP reserves the right to amend these Terms and Conditions.
- Users will be informed about any amendments by electronic means.
VIII. Final provisions
- To any matters not regulated in these Terms and Conditions the provisions of the Polish Civil Code and the Act on copyright and derivative rights apply.
- The common court having jurisdiction over the seat of Łukasiewicz – PIAP has jurisdiction to resolve any disputes resulting from these Terms and Conditions.
